What Ensured in the Supreme Court during the hearing on Maharashtra’s Power Tussle?

As per the Apex Court, the case in regard to the formation of Maharastra State Government  will be heard again on 25th November , Monday at 10: AM. After hearing the arguments of all the parties in the hearing on Sunday, the Supreme Court has given notice to both the parties and sought positive response by Monday at 10: 30 AM.

The Supreme Court ordered that after observing the latter of Support of MLAs to the Governor along with Governor’s letter of appeal to form the Government , the case will heard further.

Earlier on Saturday, after the formation of the government by BJP in the midnight accompanying a fraction of dissidents led by Ajit Pawar of NCP, the Shiv Sena, Congress and NCP filed a petition in the Supreme Court. In which there was a demand to sack the Fadnavis government and conduct a floor test within 24 hours. In this case, the supreme bench comprising of Justice NV Ramanna, Justice Ashok Bhushan and Justice Sanjeev Khanna heard the case on Sunday as an unrent matter for the sake of transparent democratic governance.

As soon as the hearing started, advocate Kapil Sibal, appearing for Shiv Sena,Congress and NCP informed the highest demiurge of the country-

“We apologize that we turned bound to call the Apex Court on this holiday of Sunday. But in the process of government formation in Maharashtra, the governor of Maharastra has sided with other political parties who also won with numbers in the state assembly election. The court should be instructed to conduct floor test within 24 hours and We are alsoready to prove our majority.”

On this, Justice Ramanna urged-

“No problem. There is no doubt that a power test is the best way to prove a majority. Anyone can ask for anything in this court.Any one also can appeal as he is the Prime Minister of the country.” 

On this conversation with Kapil Sibal, Justice Bhushan also agreed to conduct a floor test in Maharashtra at the earliest.

Then Kapil Sibal further said-

“President’s rule was removed yesterday morning at 5.17 minutes. At 8 pm, 2 people took oath as CM and deputy CM. On the basis of which document did this happen?”

On this, Mukul Rohatgi, who appeared in court on behalf of BJP, argued-

“I do not know why the hearing is being held on Sunday, there should be no hearing on Sunday. According to me, Shiv Sena, NCP and Congress should not be listed in this matter.”

Then Kapil Sibal further informed the Bench-

“People of Maharashtra want government. We are saying that we have a majority. We are ready to prove it. We will prove majority tomorrow. We should be given a chance. We have seen this in Karnataka as well. If BJP has a majority, then let them prove their majority in floor test today.”

On the issue of Majority , Mukul Rohatgi said-

“There are some things which are with the President on which judicial authorities cannot interfere.”

After all the arguments, Abhishek Manu Singhvi, appearing for Congress and NCP, said-

“When it was announced at 7 pm that we were claiming to form the government and Uddhav Thackeray would lead the government.Could not the Governor wait after this? Yesterday, the NCP decided that Ajit Pawar is not the leader of the Legislature Party. In such a situation, he does not have the support of his own party, so how can he be the Deputy Chief Minister?”

Then Mukul Rohatgi, appearing for the BJP, said-

“There should be no need for an order from the court today. The governor has not taken any wrong decision. Can the Supreme Court order to proceed with the floor test. They were all asleep for three weeks. They do not even have any document of their claims.”

Then Mukul Rohatgi further urged-

“The House honors the Court and the Court honors the House. This is the truth. Otherwise, any Assembly will pass tomorrow  that the Supreme Court will settle all the cases in two years. Time of two-three days can also be given.” 

The three parties claimed the support of more than 144 MLAs in the court. After which the bench of Justices NV Ramanna, Ashok Bhushan and Sanjeev Khanna immediately sent a notice to all the parties, rejecting the demand for floor test and seeking an answer. Now in this case, this bench will hear on Monday morning at 10:30 AM.
